Creston Police: Creston woman charged with OWI, child endangerment

Jamie N. Phelps, 27, of Creston, was taken into custody May 6 on a Union County warrant for the charges of OWI, first offense and child endangerment.

According to Creston Police reports, at approximately 4:33 p.m. April 9, a woman, later identified as Phelps, was reported to be passed out next to a vehicle parked by the air pumps at Casey’s on Taylor Street. Phelps was loaded into an ambulance for medical care. Officers observed open alcohol containers in the front passenger side of the 2019 Ford Escape as well as front passenger-side tire damage.

A child in the backseat of the car told officers he and Phelps were supposed to be going out to eat. A family member was called to pick up the child.

During an interview with Phelps, she told officers she started drinking vodka at approximately 3 p.m. but did not know how much she had drank or when her last drink was. She also said she had drank a couple of shooters. Phelps did not know how she got to Casey’s. Medics who treated Phelps advised she had admitted to drinking and also believed she was at home.

A warrant ordering a blood draw to test Phelps’ blood alcohol level was served. The specimen was collected and sent to the DCI lab. The lab report showed Phelps to have a BAC of .263%.

Phelps was transported to the Union County Jail where she was released from after posting $3,000 cash or surety bond.

Yunier Garcia Vazquez, 39, of Osceola, was taken into custody May 10 on Pine Street on the charge of OWI, first offense.

According to a Creston Police report, at approximately 1:22 a.m. a 2010 GMC Sierra was stopped for an equipment violation.

Contact was made with the driver, identified as Garcia Vazquez, who gave officers consent to search the truck. An open container of alcohol was located in the center console.

Garcia Vazquez was transported to the law enforcement center for field sobriety testing due to a language barrier. A translator was used to conduct the testing, during which he showed clues of impairment. Garcia-Vazquez said he believed he had drank so much alcohol the night before that he would still have a high BAC. He refused a PBT and refused to provide a breath specimen for testing.

Garcia Vazquez was transported to the Union County Jail where he was released from after posting $1,000 cash or surety bond.
