Adair County: Inmate charged with violating protection order using jail-issued phone

Johnathon S. Clarke, 23, of Fontanelle, was charged April 18 with violation of a no-contact/protective order, while being held in the Adair County Jail.

According to an Adair County report, on April 14 the sheriff’s office received a report that Clarke was using a jail-issued phone to contact someone listed as a protected person in two protective orders against him. The reporting party said Clarke had listed the person under a false name to continue to be able to contact them while incarcerated.

An investigation into the allegations found text messages sent and received from a phone number believed to be the protected party on April 11, 14 and 18. Phone calls to the same number were also made by Clarke on April 11.

The content of the messages and calls match information known about the protected party.

Clarke remains incarcerated at the Adair County Jail. There is no bond until his initial appearance on the newest charge.

Orton H. Wisegarver III, 40, of Stateline, Nevada, was taken into custody 9:04 p.m. April 18 at mile marker 77 of Interstate 80 on the charge of possession of a controlled substance, first offense.

According to an Iowa State Patrol report, at approximately 8:51 p.m. troopers observed a 2014 Jeep Cherokee traveling 81 mph in a 70 mph zone. A traffic stop was initiated and contact was made with the driver, identified as Wisegarver.

During the stop, troopers became suspicious of other criminal activity and requested to search the Jeep. Wisegarver refused consent. A police K-9 was then deployed and gave a positive alert to the presence of the odor of narcotics coming from the Jeep.

A probable cause search was conducted. In the Jeep, a baggie containing a white, powdery substance and a marijuana cigarette were located. The powdery substance field-tested positive for cocaine.

It was also discovered Wisegarver had five active warrants out of Cerro Gordo County, all for failure to appear. Warrant one was on the original charge of possession of a controlled substance - marijuana, first offense; warrant two original charges were interference with official acts and possession of drug paraphernalia; warrant three original charge was speeding; warrant four was for the original charge of failure to provide proof of financial liability and warrant five was for the original charge of no valid driver’s license.

Wisegarver was transported to the Adair County Jail where he posted $1,000 cash or surety bond before being released to the custody of Cerro Gordo County.
