Rory A. Davis, 22, of Creston, was into custody 2:38 a.m. Jan. 31 at Park and Stone streets on the charges of possession of a firearm or offensive weapon by domestic abuse offender; OWI, first offense, carrying a weapon while intoxicated and possession of a controlled substance, third or subsequent offense (all marijuana).
According to a Creston Police report, at approximately 2:16 a.m. a 2004 Ford F250 was observed westbound on Russell Street. At Russell and Lincoln streets, the truck’s third brake light was observed to be out. While officers were behind the truck, the driver’s side tires crossed the centerline multiple times. A traffic stop was initiated but, the truck did not pull over to the side of the road but instead came to a stop in the middle of South Stone Street.
Contact was made with the driver, identified as Davis. An uncased shotgun was observed in the passenger seat to him. Davis told officers it was loaded with a round in the chamber. While running Davis’ information, officers were told Davis is the defendant in a criminal no contact order. The order states Davis cannot possess firearms while the order is active.
When asked why he stopped in the middle of the road, Davis said because it was the middle of the night. He was observed to have bloodshot eyes, slurred speech and dilated pupils. Davis had cottonmouth and raised heat bumps on the back of his tongue, both common indicators of recent marijuana use and he made statements about smoking 3-4 hours prior.
Davis consented to field sobriety and ARIDE testing and showed numerous validated clues and indicators of impairment.
Davis refused to provide a urine sample for chemical testing, telling officers. “No, I already know I do drugs.”
During the course of the traffic stop, Davis told officers there was a small glass jar with marijuana in the vehicle. The jar was later found in Davis’ jacket pocket. He has two prior marijuana possession convictions in Union and Taylor counties.
Davis was transported to the Union County Jail and held on $9,000 cash or surety bond.

Juan C. Troconiz Atencio, 34, of Creston, was taken into custody 7:50 p.m. Jan. 31, at New York Avenue and Union Street on the charge of driving while suspended.
According to a Creston Police report, at approximately 7:44 p.m. Troconiz Atencio was observed driving a 2017 KIA Forte. Troconiz Atencio has a suspended driver’s license.
Troconiz Atencio was cited and released on summons to appear.

Randy F. Crocker, 62, of Creston, was taken into custody 8:36 p.m. Jan. 31 at his residence on a Union County warrant for the charge of failure to appear.
According to Union County District Court documents, Crocker was ordered to appear in court Jan. 30 for a show cause hearing and did not.
Crocker was transported to the Union County Jail where he was released from after posting $100 cash-only bond.
