Adair County Sheriff

Brett Christopher Havery, 43, of Omaha, Nebraska, was charged with operating while intoxicated, possession of marijuana and possession of drug paraphernalia 12:52 a.m. Nov. 22 in Adair County.

According to an Adair County Sheriff report, Havery was stopped for a speed violation of 104 miles per hour in a 70 mph zone at the 77 mile marker of the eastbound lane of Interstate 80. Upon approach of the vehicle, officers would sense a strong odor of alcohol coming from the vehicle. Officers then asked Havery to exit the vehicle and get into the passenger side of the patrol car to take care of necessary paperwork. While in the patrol car, officers could sense a strong odor of alcohol coming from Havery’s person. Officers asked how much he had had to drink, to which he replied he had a couple drinks.

Officers then advised him they were going to do some tests to ensure he was safe to drive before continuing on. After performing standardized field sobriety tests, it was determined Havery was under the influence. He was advised he was being detained and going to take another test at the jail. Officers then placed him in handcuffs and asked if he had anything they should know about. Havery then said he had marijuana and a pipe in the car. Officers found a bag of a green leafy substance consistent with marijuana in his coat pocket. They also found the pipe in the center console.

Havery was then transported to Adair County Jail. He was read implied consent and a Data Master result showed .185 blood alcohol content.

Havery was released on his own recognizance.
