Gunner M. Namanny, 19, of Anita, was taken into custody 2:19 a.m. Nov. 14, at the Southwestern Community College parking lot on the charges of possession of a controlled substance - marijuana, first offense, OWI, second offense and possession of drug paraphernalia.
According to a Creston Police report, a patrol officer observed a 2013 Dodge Avenger parked by itself in the back of one of the dorm parking lots at SWCC, with its headlights on. The officer had also seen the vehicle there earlier in the evening and drove through the parking lot to see if it was occupied. A male, later identified as Namanny, was seated in the driver’s seat with his head down on his chest, as if he were sleeping.
Officers parked near the Dodge. As they exited the patrol car they heard very loud music coming from the car and noticed it was running.
When they approached the Dodge, they saw multiple beer cans throughout the car. Officers knocked on the car window then pounded on the window with their fist in attempt to wake Namanny up but were unable. They finally were able to wake him after opening the unlocked driver’s door and shaking Namanny by the shoulder.
Namanny was asked to turn down the music to speak with officers and instead, turned the dial for the fan speed of the car’s heating and air-conditioning system. He had slurred speech, bloodshot, watery eyes, dilated pupils and a strong odor of a consumed alcoholic beverage coming from his breath. There was also the odor of marijuana coming from the vehicle.
Namanny admitted to drinking four Bud Lights earlier in the night and to smoking marijuana two hours earlier.
When exiting the car after being asked, Namanny was observed to have impaired balance. He was asked for his driver’s license but said he didn’t have it or his wallet with him. The outline of his wallet was visible in his front pant pocket so officers had him check his pockets, which he did and produced his wallet. He then asked if he could look for his wallet in the car while holding it in his hand. Namanny was told multiple times he was holding his wallet and looked at his wallet and said multiple times he did not have it.
Namanny refused all field sobriety testing and a PBT. A probable cause search of the vehicle resulted in officers locating 11 empty Bud Light bottles and four assorted open alcoholic containers. Officers also located three containers marked “marijuana” with marijuana residue in them, a box marked “marijuana vape cartridge,” a grinder containing marijuana residue and a device used to smoke marijuana.
Namanny was transported to the Union County Law Enforcement Center where he consented to provide a breath specimen for chemical testing. The result indicated his BAC to be .195%.
Namanny has a prior OWI conviction in Union County in May.
He was taken to the Union County Jail where he was released from after posting 10% of a $3,000 cash bond.
