Creston Police: Driver falls asleep during arrest

Jose R. Flores, 40, of Creston, was taken into custody 12:18 a.m. Oct. 4, at Lucas and Vine streets on the charge of driving while suspended.

According to a Creston Police report, at approximately 12:11 a.m. Flores was observed driving a 2007 Hummer H2. Flores was found to have a suspended driver’s license.

Flores was cited and released at the scene on a summons to appear.

Bradford G. Boyer, 26, of Kent, was taken into custody 1:48 a.m. Oct. 4, in the 1700 block of 160th Street on the charges of OWI, second offense and possession of a controlled substance - marijuana, second offense. He was also cited for failure to carry vehicle registration card, failure to provide proof of financial liability, open container and driving on the wrong side of a two-way highway.

According to a Creston Police report, at approximately 1:41 a.m. a Toyota Celica was observed eastbound on Howard Street, the Toyota then turned north on Osage Street then east on 160th Street, weaving as it proceeded.

The Toyota went to the far right edge of the road then swerved, crossing the center of the road before going to the far left side and into the wrong lane of traffic.

A traffic stop was conducted and contact was made with the driver, identified as Boyer, who had slurred speech, bloodshot, watery eyes and the odor of a consumed alcoholic beverage coming from his person.

Boyer denied drinking any alcohol or using any drugs. Open alcohol containers were observed on the passenger floorboard.

Boyer was asked to step out of the vehicle and was observed to have impaired balance. While attempting to put his phone in his pocket, he missed his pocket and dropped it on the ground.

He refused field sobriety testing and PBT. Officers read Boyer his Miranda Rights. Boyer said he did not understand them, so officers read them a second time, during which Boyer closed his eyes and fell asleep.

Boyer fell asleep multiple times in the patrol car and while at the Union County Law Enforcement Center. He had difficulty walking up the stairs at the law center and required assistance several times.

He refused to provide a breath sample for chemical testing. During a probable cause search of the Toyota, officers located a baggie with a yellow wax substance in it. The substance smelled like marijuana and field-tested positive for marijuana.

Boyer was transported to the Union County Jail where he was released from after posting $3,000 cash or surety bond.
