Creston Police: Kentucky driver charged with OWI and drug possession

Lela A. Churchwell, 46, of Creston, was taken into custody 1:48 p.m. Aug. 25, in the 200 block of North Oak Street on the charges of disorderly conduct - loud raucous noise, public intoxication and interference with official acts.

According to a Creston Police report, at approximately 1:03 p.m. Churchwell was reported for being loud and very intoxicated on Oak Street. This was after she had previous contact with law enforcement and was told to go back inside. Churchwell disregarded orders and continued to cause disturbances which required police to return.

Churchwell was visibly impaired and had slurred speech, bloodshot, watery eyes and a strong odor of an alcoholic beverage coming from her breath.

During the interaction with police, Churchwell ran inside an apartment while being ordered to stop. After being taken into custody, she resisted during the entire trip to the law enforcement center.

Churchwell was transported to the Clarke County Jail and held on $900 cash or surety bond.

Frank T. Infante-Silva, 52, of Louisville, Kentucky, was taken into custody 11:31 p.m. Aug. 25, in the 800 block of West Taylor Street on the charges of OWI, first offense and possession of a controlled substance - marijuana, first offense.

According to a Creston Police report, while running stationary radar in the 600 block of South Sumner Avenue, officers observed a 2013 Hyundai Sonata traveling 38 mph in a 25 mph zone. A traffic stop was conducted at the Quality Inn parking lot and contact was made with the driver, identified as Infante-Silva.

While speaking with Infante-Silva, officers detected the odor of marijuana coming from the vehicle and observed a THC vape in plain view in the center console. A probable cause search of the vehicle was conducted and produced a partially smoked and full marijuana blunt and several buds of marijuana.

When asked when the last time he had smoked was, he told officers it had been a long time. Infante-Silva was observed to have bloodshot, watery eyes. He also had a green coating and raised heat bumps on his tongue, common with someone who has recently smoked marijuana.

Infante-Silva refused field sobriety testing and refused to provide a urine specimen for chemical testing.

Silva was transported to the Union County Jail and held on $2,000 cash or surety bond.
