Nicholas A. Foltz, 42, of Mount Ayr, was taken into custody 1:03 a.m. May 11 at the Union County Law Enforcement Center on the charges of OWI, first offense and possession or carrying of dangerous weapons while intoxicated.

According to a Creston Police report, at 11:57 p.m. May 10, a 2018 GMC Sierra was stopped at Montgomery and Cherry streets after it was observed eastbound with no headlights or taillights on. Contact was made with the driver, identified as Foltz, who had bloodshot, watery eyes and slurred speech. A strong odor of an alcohol was detected coming from the vehicle.

While Foltz was looking for his insurance information, officers observed a firearm in the center console of the truck. Foltz was asked to step out of the vehicle and asked if he had any weapons. He told officers of the gun, which was found to be loaded.

Foltz admitted he drank at a winery in Corning earlier in the evening. He consented to field sobriety testing and showed numerous validated clues of impairment and a PBT result indicated a BrAC of over .08%.

Foltz was transported to the law enforcement center where he consented to provide a breath sample for chemical testing, which resulted in a BAC of .123%.

Foltz was transported to the Union County Jail where he was released from after posting $2,000 cash or surety bond.

Destiny M. Schneider, 21, of Creston, was taken into custody 1:12 a.m. May 12 at the intersection of New York Avenue and South Sumner Street on the charge of OWI, first offense.

According to a Creston Police report, at approximately 12:50 a.m. a 2014 Ford Focus was stopped for speeding. Contact was made with the driver, identified as Schneider, who had slurred speech and admitted to consuming two alcoholic drinks. An odor of an alcoholic beverage was detected coming from inside the vehicle.

Schneider consented to and failed field sobriety tests. She refused PBT. After being transported to the law enforcement center, she consented to provide a breath specimen for chemical testing, the result indicated a BAC of .16%, twice the legal limit.

Schneider was transported to the Union County Jail where she was released from after posting $1,000 cash bond.

Ashley D. Parrott, 36, of Greenfield, was taken into custody 3:41 a.m. May 12 at the intersection of Summit and Oak streets on the charge of OWI, first offense.

According to a Creston Police report, at approximately 3:15 a.m. a 2008 Hyundai Elantra was stopped for having a headlight out. Contact was made with the driver, identified as Parrott, who rolled down both the front and back driver’s side windows when officers approached the vehicle.

Parrott had bloodshot, watery eyes, slurred speech and the odor of an alcoholic beverage coming from her breath. She admitted to drinking alcoholic beverages at a friends.

Parrott consented to field sobriety testing and showed numerous validated clues of impairment. She refused PBT. After being transported to the law enforcement center, she consented to provide a breath sample for chemical testing, the result indicated a BAC of .097%.

Parrott was transported to the Union County Jail where she was released from after posting $1,000 cash or surety bond.

Andrew F. Weis, 21, of Creston, was taken into custody 4:48 a.m. May 12 in the 500 block of North Cherry Street on the charge of OWI, second offense.

According to a Creston Police report, at approximately 4:12 a.m. Weis was involved in a one-vehicle accident in which he left the roadway in a 2013 Chevrolet Silverado and hit two trees at Summit and Cherry streets.

While investigating the accident, officers observed the strong odor of an alocholic beverage on Weis’s breath and in the vehicle and an open container in the truck. Weis consented to field sobreity testing and showed signs of impairment. He refused PBT.

Weis was transported to the law enforcement center where he consented to provide a breath sample for chemical testing, the result indicated a BAC of .168%, more than double the legal limit.

Weis was convicted of OWI, first offense, Aug. 4, 2023, in Union County.

Weis was transported to the Union County Jail where he was released from after posting $2,000 cash or surety bond.
