Donald L. Gay, 47, of Villisca, was taken into custody 9:56 p.m. April 16 in the 800 block of West Adams Street on the charge of OWI, first offense.

According to a Creston Police report, while officers were investigating a complaint involving Gay, it became known he had driven a vehicle while intoxicated to the mentioned location. Gay showed signs of impairment and consented to field sobriety testing, the results of which indicated significant signs of impairment. A PBT test provided a BrAC of above .08%.

Gay was transported to the Union County Law Enforcement Center where he consented to provide a breath specimen for chemical testing. The result indicated a BAC of .185%.

Gay was transported to the Union County Jail where he was released from after posting $1,000 cash or surety bond.

At approximately 12:45 a.m., April 16, officers responded to the same location for a reported assault. The victim there said after Gay was released from jail, he came to the residence and began yelling at the victim, threatening to assault him.

A female at the residence attempted to get between Gay and the victim. Gay reached over the female’s head and punched the victim in the nose.

Gay was charged with public intoxication and assault as a result.

Gay was transported to the Union County Jail where he was released from on his own recognizance on a promise to appear, after seeing the magistrate.
