Creston Police arrest report - April 4, 2024

Michael J. Spaulding, 76, of Creston, was taken into custody 5:39 p.m. April 3 at his residence on the charge of operating while under the influence, first offense.

According to a Creston Police report, at approximately 10:23 p.m. Feb. 23 a 2012 Harley Davidson, driven by Spaulding, was involved in a one-vehicle accident at Mills and Cherry streets. At the time of the accident, Spaulding told officers he had too much to drink and estimated he drank 10 beers at a local bar. Spaulding had bloodshot, watery eyes and thick, slurred speech.

He was transported by ambulance to Greater Regional Health for injuries sustained in the accident but consented to provide a urine sample for chemical testing. The sample was sent to Iowa DCI for testing and results received March 8 indicated Spaulding to have a BAC of .109%.

Spaulding was cited and released at the scene on a promise to appear.

Andres Martinez Jr., 28, of Creston, was taken into custody 6:45 p.m. April 3 at his residence on the charge of domestic abuse assault, first offense.

According to a Creston Police report, at approximately 6:04 p.m. officers responded to a domestic disturbance in the 500 block of West Montgomery Street. A female at the residence said she and Martinez had been arguing and she went to the kitchen and threw a cup and plate at the ground out of anger. Martinez then came into the kitchen and physically restrained her from behind and kicked her to trip her and landed on top of her with his entire body weight. The female said Martinez then held her down with his arm around her neck but did not choke her.

She said she attempted to fight back and was able to get away from him. She had a red mark on her shin from where she was kicked and marks on the left side of her neck.

Martinez told officers he heard items breaking in the kitchen and walked in the room, grabbed the female and stepped in front of her to trip her and take her to the ground. He said he did so gently and held her down for a short time. He had a carpet burn on his left arm.

Martinez was transported to the Union County Jail where he was released from on his own recognizance after seeing the magistrate.
