Danny Eltino Guzman, 22, 1000 W. Montgomery St., and Norskuski Philanda Rivers Jr., 19, 304 W. Lucas St., were charged with failure to affix a drug tax stamp, possession with intent to sell, marijuana, under 50 kilograms, and possession of paraphernalia, and Guzman was additionally charged with interference with official acts 10:22 p.m. Thursday at Rivers’ residence.

According to a Creston Police report, officers received a report from the owner of 304 W. Lucas St., saying there was possible drug activity going on in her rental apartments. Officers arrived at the residence with the owner and obtained permission to enter the residence from another subject who lived in the upstairs apartment. The subject was a roommate to Rivers. While inside the residence, officers observed in plain view a duffle bag on the floor next to a house guest by the name of Guzman while he sat on the couch. The duffle bag was unzipped, the flap was open and the contents of the bag were revealed, which was several bags of marijuana. Also on the couch next to Guzman was a stack of bills.

In two bedrooms adjacent to the living room, also in plain view, were individual bags of marijuana, a scale and a smoking bong. Rivers was in control of the apartment and was aware of the activity going on in his apartment area but denied any of the marijuana and money to be his. Because of the availability of immediate control and no confessed ownership, Rivers was charged. All activity happened within 1,000 feet of a school or playground.

Guzman had possession of 264 grams of a green leafy substance believed to be marijuana without affixing the appropriate stamp and possessed a glass bong. He also had a large amount of cash on his person and a box of small bags in the same location as the green leafy substance. Guzman resisted a uniformed police officer by running while in handcuffs.

Guzman and Rivers were each being held on $5,000 bond.
