Justin David Wendelboe, 28, of Des Moines was charged with second-offense operating while intoxicated, having no insurance, failure to maintain control and operating without registration 9:44 p.m. Friday in Adair County.

According to an Adair County Sheriff report, officers responded to a single-vehicle accident near the 85-mile marker on Interstate 80. When officers arrived on scene, they found a gray Chevrolet passenger vehicle sitting in the north ditch with one person standing next to it. The male subject was swaying as he stood. Officers made contact with the subject, who began speaking to them. As he spoke, officers could smell a very strong odor of an alcoholic beverage coming from his person. The subject’s eyes were very watery and bloodshot.

Officers asked the subject what was going on and he said he was heading to his house. The subject had very slurred speech and was hard to understand. He denied driving but the vehicle was registered to him, and he was also the only person on scene. The subject said a friend had left the scene, but refused to say who was driving, only saying he had just met the driver recently and refusing to give officers any information about the supposed driver.

Officers located the driver’s cell phone and with his consent made several observations in his call log and text messages. The subject had texted a friend saying he would be meeting him the night of the incident. Officers called the friend the subject had texted. The friend said he had dinner with the subject in Des Moines, finishing at about 7 p.m. The friend then said the subject got into his vehicle alone and drove away.

The subject’s spouse was notified of the incident and called Adair County Sheriff’s Office wanting to know about the incident. Officers spoke to the spouse on the phone, who said the subject gets intoxicated often and, when he is intoxicated, becomes extremely confused. Officers were convinced the subject had been driving the vehicle. The subject was asked consent for field sobriety testing and consented to the request. The subject failed sobriety tests. The driver was then offered a preliminary breath test and consented to the test. The test results indicated an alcohol concentration of more than .08. The driver was taken into custody and transported to Adair County Jail for further testing. Once inside the jail, the subject was asked for a sample of his breath to be tested on the DataMaster. The driver consented to the request and gave a sample that tested .231 blood-alcohol content.

Wendelboe was released on $2,000 bond.
