Brian Clair Smith, 35, 807 N. Vine St., was charged on a Union County warrant for second-offense delivery of a controlled substance, methamphetamine, 4:33 p.m. Thursday at his residence.

According to a Creston Police report, Smith sold approximately three grams of methamphetamine for $300. A special agent was present during the transaction. The transaction was also monitored and recorded by law enforcement personnel. Smith was previously convicted of possession of a controlled substance, methamphetamine, with intent to deliver in March 2002 in Ringgold County.

Smith was being held on $50,000 bond.

Dusten Jacob Thrasher, 27, of Des Moines was charged on a Union County warrant for public intoxication and unlawful possession of a prescription drug 3:05 a.m. Friday at the intersection of West Adams and North Sycamore streets.

According to a Creston Police report, Thrasher was intoxicated in a public place while on North Elm Street. A witness called and reported Thrasher had fallen down and was acting very intoxicated. Thrasher’s speech was slurred, and he was very unsteady. He had a strong odor of an alcoholic beverage that got stronger as he spoke. Thrasher consented to a DataMaster test with a result above .08. Thrasher was also in possession of four Xanax pills in a small plastic bag commonly used in the sale and usage of illegal drugs without a prescription. The pills were not labeled with a scrip number or name of any kind.

Thrasher was being held on $5,000 bond.

Andrew Moffitt, 29, 704 New York Ave. Apt. 2, was charged on a Union County warrant for probation violation 12:33 p.m. Friday in the 500 block of West Mills Street.

Moffitt was released on $2,000 bond.

Colton Eugene Dunphy, 24, 1645 185th St., was charged with operating while intoxicated 2:33 a.m. Saturday at the intersection of South Sumner Avenue and Fremont Street.

According to a Creston Police report, officers conducted a stop on a vehicle being driven by Dunphy for several traffic violations. Dunphy had an odor of an alcoholic beverage coming from his person and consented to standardized field sobriety tests and a preliminary breath test, which indicated impairment. Dunphy was taken into custody and transported to the Union County Law Enforcement Center, where he consented to a DataMaster test, providing a breath sample of .174.

Dunphy was released on $1,000 bond.

Shaun James Walkup, 29, of Diagonal was charged with public intoxication 2:28 a.m. Sunday at the intersection of East Montgomery and North Pine streets.

According to a Creston Police report, Walkup was making comments while the officer was speaking with other individuals that caused a disruption. Walkup shouted at the officer to move on. The officer approached Walkup to deal with the disruption and noticed Walkup was highly intoxicated. Walkup exhibited a very strong odor of an alcoholic beverage, had bloodshot and watery eyes, slurred speech and impaired balance. Walkup refused to take DataMaster or preliminary breath tests.

Walkup was released on $300 bond.

Robby Lee Fleming, 42, 509 S. Vine St., was charged with assault 8:28 p.m. Sunday at Union County Law Enforcement Center.

According to a Creston Police report, Jacob Davis of Creston said he was walking in the vicinity of West Adams and North Division streets when he was approached by Fleming. Words were exchanged between the two, and Fleming shoved Davis out of anger. After the altercation, Davis left the scene and reported the incident.

Fleming was released on promise to appear.

Justin Robert Rugaard, 1104 W. Adams St., reported a 4400-watt generator was taken between 8 p.m. Wednesday and 9 a.m. Thursday from the back of his truck while it was parked at his residence.

Loss estimate is $350.

Carla Millard, 522 Wyoming Ave., reported her motorcycle had been knocked over between 8 p.m. Wednesday and 9 a.m. Thursday while it was parked in the 100 block of North Elm Street.

Damage estimate is $100.

Jonathan Zollman, 403 N. Elm St., reported his white 2000 Chevrolet Cavalier was taken between 6 p.m. Saturday and 5 a.m. Sunday from his residence.

The vehicle was recovered Sunday in the 600 block of North Pine Street.

Tammy McNaughton, 604 W. Montgomery St., reported damage was done to her door and lock between 2 a.m. and 5 p.m. Sunday.

Damage estimate is $30.
