Manuel Allen Silva Jr., 44, 1951 Beechwood Ave., was charged on a Union County warrant for two counts of third-degree sexual abuse 11:12 a.m. Tuesday at Union County Law Enforcement Center.

According to a Creston Police report, on May 28, during the evening, a female victim was at the home of Silva. While at his residence, Silva gave the victim a beverage which he observed her consume. After consuming this beverage, the victim became “groggy” and fell asleep on Silva’s couch. She described feeling tired, unsteady and in a dream-like state. Silva lay beside the victim on the couch, placed his hands down the victim’s pants and digitally penetrated her vaginal area. Silva additionally exposed his penis and placed his penis in the hand of the victim, at which time she pulled her hand away. These actions by Silva to the victim were done without her consent and against her will.

On May 30, the events were reported to law enforcement. A blood and urine sample were taken from the female victim as part of a medical examination. Urinalysis of the sample resulted in the discovery of a benzodiazepine in the body of the victim. Further analysis resulted in the identification of the drug Temazepam. The victim was not on any prescription medication at the time of the alleged assault, nor did she otherwise take any such medication with her knowledge or consent.

On June 10, a subpoena was obtained and served upon employees of the Walmart pharmacy, 806 Laurel St. As a result of this subpoena, it was discovered Silva’s wife had been prescribed Temazepam. It was also discovered during this investigation Silva had access to his wife’s medication.

Silva was released on $20,000 bond.

Anthony James Gross, 42, 430 Livingston Ave., was charged with second-offense public intoxication 6:05 p.m. Tuesday at 200 S. Elm St.

According to a Creston Police report, officers received a call for a man who was stumbling around South Elm Street and fell in the middle of the road. Officers arrived on scene and saw a man sitting along the road. The man was identified as Gross. When officers talked to him, officers could smell alcohol on his person, and he admitted to drinking a lot during the day. Officers had to help Gross get up and go to the patrol car. Officers asked Gross if he would do a preliminary breath test. Gross said he would, and the preliminary breath test showed he had a blood alcohol content of .258, which is above the legal limit of .08.

Gross was being held on $1,000 bond.
